Terms of Service

1. Acceptance of Terms

By accessing and using Anjean ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform. These Terms apply to all visitors, users, and others who access or use the Platform.

2. Description of Service

Anjean is an online platform that connects travelers ("Guests") with local tour guides ("Guides") in Japan. We provide a marketplace for Guides to offer their tour services and for Guests to discover and book these experiences.

Anjean acts solely as an intermediary between Guests and Guides. We do not provide tour services directly and are not responsible for the actual tours conducted by Guides.

3. User Accounts

3.1 Account Creation

To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. Guide Responsibilities

If you register as a Guide on our Platform, you agree to:

  • Provide accurate information about yourself and your tour offerings
  • Maintain all necessary licenses, permits, and insurance required to conduct tours in Japan
  • Deliver tours as described in your listings
  • Communicate professionally and respond promptly to Guest inquiries
  • Comply with all applicable laws and regulations
  • Not discriminate against Guests based on race, religion, nationality, gender, or other protected characteristics

5. Guest Responsibilities

As a Guest using our Platform, you agree to:

  • Provide accurate booking information
  • Arrive on time for scheduled tours
  • Treat Guides and other participants with respect
  • Follow Guide instructions during tours
  • Comply with all applicable laws and local customs
  • Not engage in any illegal or disruptive behavior during tours

6. Bookings and Payments

6.1 Booking Process

When you book a tour through our Platform, you enter into a direct agreement with the Guide. Anjean facilitates this transaction but is not a party to the agreement between you and the Guide.

6.2 Payment

All payments are processed through our secure payment system. By making a booking, you authorize us to charge your payment method for the total booking amount, including any applicable fees.

6.3 Cancellation Policy

Cancellation policies vary by tour and are set by individual Guides. Please review the cancellation policy before booking. In general:

  • Cancellations made 48+ hours before the tour: Full refund
  • Cancellations made 24-48 hours before the tour: 50% refund
  • Cancellations made less than 24 hours before the tour: No refund

7. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Anjean or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. User Content

By posting content on our Platform (including reviews, photos, and tour descriptions), you grant Anjean a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with our services.

9. Limitation of Liability

To the maximum extent permitted by law, Anjean shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or any tours booked through the Platform.

We do not guarantee the quality, safety, or legality of tours offered on the Platform. Guests participate in tours at their own risk.

10. Indemnification

You agree to indemnify and hold harmless Anjean and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Platform or violation of these Terms.

11. Dispute Resolution

Any disputes between Guests and Guides should first be resolved directly between the parties. If resolution cannot be reached, please contact our support team for assistance.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on the Platform. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tokyo, Japan.
